The Federal High Court sitting in Abuja has restrained the Independent National Electoral Commission (INEC) from recognising former Senate President, David Mark and ex-Osun State governor, Rauf Aregbesola, as interim National Chairman and National Secretary of the African Democratic Congress (ADC).
Naija News reports that Justice Emeka Nwite granted the interim injunction following a motion ex parte dated September 2, 2025, filed by Nafiu Gombe.
In the suit, the ADC, Mark and Aregbesola were listed as the first, second and third defendants, while INEC and a former national chairman of the party, Ralph Nwosu, were joined as the fourth and fifth defendants.
The judge ruled that INEC must not recognise the pair or their representatives pending the determination of a motion on notice already filed in the matter.
The ruling effectively suspends INEC’s earlier action in which it had updated its website to reflect Mark and Aregbesola as leaders of the ADC.
Justice Nwite’s order places the status of the two politicians in limbo until the substantive application is heard.
This comes after INEC officially acknowledged David Mark as the new National Chairman of the African Democratic Congress (ADC), and Aregbesola as the National Secretary.
In a post via 𝕏 account on Wednesday, the National Publicity Secretary of the ADC, Bolaji Abdullahi, confirmed that INEC has recognized the new executives of the party led by former Senate President, David Mark.
